I. Principle

This is to inform you about the collection, storage and processing of your data; the European General Data Protection Regulation forms the basis for the handling of your data.

As a general rule we collect the data concerned only for the fulfilment of contractual or pre-contractual obligations within the meaning of art. 6 lit.b of the GDPR and transmit these only after the express consent of the party concerned.

If applicable, it may be necessary to collect the data of those involved in legal proceedings, in particular, but not exclusively within the scope of application of the Code of Civil Procedure and the German Family Court proceedings.

II. Data connections

By accessing our website www.erbenermittlung-ely.de information is automatically sent to the server for our website by the Browser used on your device. In order to troubleshoot technical problems every page access is saved for six weeks with IP address, date, time, “User Agent” transmitted by the Browser, error code and number of bytes transmitted.

III. Transmission of data

Your personal data is not transmitted to third parties for purposes other than those described.

• You have given express consent for this, according to art. 6 par. 1 p. 1 lit. of the GDPR,
• Transmission is necessary in accordance with Art. 6 (1) p. 1 lit. f GDPR for the enforcement, exercise, or defence of legal claims and there is no reason to believe that you have an overriding legitimate interest in the non-disclosure of your data,
• In the event that a legal obligation exists for disclosure in accordance with Art. 6 (1) p. 1 lit. c GDPR, as well as
• This is legally permissible and according to Art. 6 (1) p. 1 lit. b GDPR is necessary for the processing of contractual relationships with you.

IV. Data subject rights

You have the right:

• pursuant to art. 15 of the GDPR, to request information about your personal data processed by us. In particular, you may request information about the processing purposes, the categories of personal data, the categories of recipients towards which your data is, or was, made available, the planned retention period, the existence of a right to correction, erasure, limitation of processing or objection, the existence of a right to appeal, the origin of your data, if not collected by us, as well as regarding the existence of an automated decision-making process including profiling and, if applicable, meaningful information regarding their details;
• pursuant to art. 16 of the GDPR to request immediate correction of incorrect data, or completion of your personal data stored by us;
• pursuant to art. 17 of the GDPR, to request the erasure of your personal data stored with us insofar as the processing is not necessary for the exercise of the right to freedom of expression and information, for the fulfilment of a legal obligation, for reasons of public interest or assertion, exercise of defence of legal claims;
• pursuant to art. 18 of the GDPR to request e restriction of the processing of your personal data insofar as you dispute the accuracy of the data, the processing is unlawful, but you reject its deletion and we no longer require the data, you, however, require it for the enforcement, exercise, or defence of legal claims or you have filed an objection to the processing in accordance with art. 21 of the GDPR;
• pursuant to art. 20 of the GDPR, to obtain your personal data that you have provided to us, in a structured, common, and machine-readable format, or to the extent technically feasible, to request transfer directly to another person responsible;
• pursuant to art. 7 par. 3 of the GDPR, you may revoke the consent you have granted to us at any time. As a result, we will no longer to continue the data processing in future which, until then, was based on this consent, and
• pursuant to art. 77 of the GDPR to complain to a supervisory authority. As a general rule you may turn to the supervisory authority of your usual residence or workplace or our headquarters.

V. Right of objection

If your personal data is processed on the basis of legitimate interests in accordance with art. 6 (1) p. 1 lit. f of the GDPR you have the right, pursuant to art. 21 of the GDPR, to file an objection to the processing of your personal data if there are grounds therefore resulting from your particular situation or the objection is based on opposition to direct advertising. In the latter case you have general right of objection which will be implemented by us without specifying a particular situation.

VI. Security

Within your visit to the website we use the popular SSL procedure (Secure Socket Layer) in conjunction with the highest level of encryption supported by your browser.
